Acceptable Use Policy

NOVA Acceptable Use Policy

This Acceptable Use Policy ("AUP") explains the standards that apply when you use NOVA, including the NOVA mobile application, website, communities, messaging services, matching features, profiles, activities, and other services we make available (collectively, the "Services").

NOVA is designed to help people build meaningful connections, participate in communities, discover shared interests, develop relationships, and engage with other members respectfully.

By using NOVA, you agree to comply with this AUP, our Terms of Service, Privacy Policy, and any other policies or rules that apply to the Services.

If you do not agree with this AUP, you must not use NOVA.

Our Approach to Community Safety

NOVA is intended to be a welcoming environment where people can connect, communicate and participate in communities without being subjected to abuse, harassment, discrimination, fraud or other harmful behaviour.

We support open and respectful discussion, including discussion of culture, identity, relationships, religion, politics, society, careers and other topics where permitted by law and our policies.

However, freedom to express an opinion does not give anyone the right to threaten, harass, exploit, discriminate against or otherwise harm another person.

We may take action where content or behaviour violates this AUP, our Terms of Service, applicable law, or creates a credible risk to the safety or integrity of the NOVA community.

Who This Policy Applies To

This AUP applies to everyone who uses NOVA, including:

  • Registered members;

  • Free and paid members;

  • Users participating in communities;

  • Users communicating through private or group messaging;

  • Users using matching or relationship features;

  • Users creating or sharing content;

  • Users organising or participating in activities;

  • Businesses, organisations or other entities using NOVA where permitted;

  • Anyone accessing or interacting with the Services.

You are responsible for your own conduct and for content you submit, upload, publish, transmit or otherwise make available through NOVA.

Use NOVA Lawfully and Responsibly

You must use NOVA:

  • Lawfully;

  • Honestly;

  • Respectfully;

  • For its intended purposes;

  • In accordance with this AUP and our Terms of Service;

  • Without interfering with the experience, privacy, safety or security of other users.

You must not use NOVA to facilitate, encourage, promote or participate in unlawful activity.

 

5. Prohibited Behaviour

The following activities are prohibited on NOVA.

5.1 Harassment, Bullying and Intimidation

You must not:

  • Harass, bully, intimidate or repeatedly target another person;

  • Make unwanted repeated contact after someone has asked you to stop;

  • Deliberately humiliate, degrade or threaten another user;

  • Organise other people to harass or target someone;

  • Use messaging or community features to deliberately cause distress;

  • Engage in persistent unwanted attention or contact.

A disagreement, rejection or difference of opinion does not justify harassment.

 

5.2 Threats and Violence

You must not use NOVA to:

  • Threaten violence against another person;

  • Encourage or glorify violence against individuals or groups;

  • Make credible threats of physical harm;

  • Encourage someone to harm themselves or another person;

  • Coordinate acts of violence or other serious criminal activity.

Where we reasonably believe there is an immediate or serious risk of harm, we may take appropriate action, including restricting access to NOVA and, where appropriate and legally permitted, contacting relevant authorities.

 

5.3 Hate Speech and Discrimination

NOVA welcomes people from diverse backgrounds and communities.

You must not use NOVA to promote, encourage or participate in hateful or discriminatory conduct targeting people because of characteristics protected under applicable law.

This includes, for example:

  • Race or ethnic origin;

  • Nationality;

  • Religion or belief;

  • Sex or gender;

  • Sexual orientation;

  • Disability;

  • Age;

  • Other legally protected characteristics.

We distinguish between discussing sensitive or controversial subjects respectfully and attacking or dehumanising people because of who they are.

Content that expresses a legitimate opinion or discusses cultural, religious, political or social issues may be permitted where it does not cross into prohibited abuse, threats, harassment or discriminatory conduct.

Sexual Harassment and Unwanted Sexual Behaviour

You must not:

  • Send unwanted sexually explicit messages or images;

  • Make repeated sexual requests after someone has declined;

  • Pressure another person to engage in sexual activity;

  • Use sexual comments to harass or intimidate another user;

  • Share intimate or sexual material of another person without their consent;

  • Threaten to disclose intimate material;

  • Attempt to obtain intimate content through coercion, manipulation or deception.

Consent must be freely given and can be withdrawn at any time.

A user's participation in a conversation, relationship or match does not constitute consent to sexual communication or activity.

 

7. Exploitation and Abuse

You must not use NOVA to exploit, manipulate or abuse another person.

This includes:

  • Grooming;

  • Coercive or controlling behaviour;

  • Sexual exploitation;

  • Financial exploitation;

  • Blackmail or extortion;

  • Manipulation intended to obtain money, property, personal information or intimate material;

  • Taking advantage of a person's vulnerability;

  • Facilitating trafficking or exploitation.

NOVA does not tolerate the exploitation of children or vulnerable people.

 

8. Minors and Child Safety

NOVA is intended for users who meet the minimum age requirement stated in our Terms of Service and applicable registration requirements.

You must not:

  • Use NOVA to engage in sexual or romantic activity with a minor;

  • Attempt to arrange sexual contact with a minor;

  • Request, create, possess, distribute or share child sexual abuse material;

  • Groom or sexually exploit a minor;

  • Encourage a minor to move an interaction to another platform for abusive or exploitative purposes.

Any content involving child sexual exploitation or abuse may be reported to the appropriate authorities or relevant organisations where required or permitted by law.

We may immediately restrict or terminate accounts where we reasonably believe there is a serious child-safety concern.

 

9. Fraud, Scams and Financial Exploitation

NOVA must not be used to deceive people for financial or personal gain.

You must not:

  • Conduct romance scams;

  • Request money from users through deception;

  • Pretend to be experiencing an emergency to obtain money;

  • Promote fraudulent investment opportunities;

  • Conduct phishing or payment fraud;

  • Misrepresent financial opportunities;

  • Solicit cryptocurrency or other financial transfers through deceptive means;

  • Impersonate financial institutions or legitimate businesses;

  • Use a romantic or social relationship primarily as a means of obtaining money or financial benefit.

Users should exercise caution when another person asks for money, financial information, investments, gift cards, cryptocurrency or other financial assistance.

NOVA does not guarantee the identity, intentions, financial position or trustworthiness of another user.

 

10. Impersonation and Misrepresentation

You must not deliberately misrepresent your identity or impersonate another person, organisation or public figure in a way that is intended to deceive or cause harm.

This includes:

  • Creating a profile using another person's identity;

  • Pretending to represent NOVA when you do not;

  • Impersonating a public figure;

  • Misrepresenting your relationship with another person or organisation;

  • Using misleading information to obtain another user's trust for fraudulent or harmful purposes.

NOVA encourages users to represent themselves honestly.

You should not use another person's photographs, personal information or identity without appropriate permission.

 

11. Fake Accounts and Platform Manipulation

You must not create or operate accounts for the purpose of manipulating NOVA or misleading other users.

This includes:

  • Creating multiple accounts to evade restrictions;

  • Creating fake profiles to deceive users;

  • Operating automated or coordinated accounts without NOVA's permission;

  • Manipulating matches, recommendations, rankings or engagement;

  • Artificially inflating community activity;

  • Using accounts to test, scrape or manipulate the platform without authorisation.

We may restrict accounts where we reasonably believe they are being used to manipulate the Services or circumvent enforcement measures.

 

12. Spam and Unsolicited Commercial Activity

You must not use NOVA to send:

  • Bulk unsolicited messages;

  • Repeated promotional messages;

  • Unsolicited advertising;

  • Mass invitations;

  • Referral spam;

  • Malicious links;

  • Repetitive promotional content;

  • Unauthorised commercial solicitations.

Commercial activity may only take place where NOVA expressly permits it.

You must not exploit messaging, communities or matching features as a substitute for an unsolicited marketing database.

 

13. Unauthorised Selling and Solicitation

Unless expressly permitted by NOVA, you must not use the Services to:

  • Sell products or services;

  • Recruit customers;

  • Recruit users into multi-level marketing schemes;

  • Promote fraudulent business opportunities;

  • Solicit donations deceptively;

  • Promote financial schemes;

  • Recruit people into unlawful activities;

  • Conduct unauthorised fundraising.

NOVA may remove commercial or promotional content that is inconsistent with the purpose of a particular community or feature.

 

14. Privacy and Personal Information

You must respect the privacy of other NOVA users.

You must not:

  • Publish another person's private information without appropriate permission;

  • Share private contact details to intimidate, expose or target someone;

  • Publish home addresses;

  • Share private telephone numbers;

  • Share private email addresses;

  • Share financial information;

  • Share confidential employment or professional information;

  • Attempt to obtain another user's account credentials;

  • Use personal information obtained through NOVA for harassment, stalking, fraud or other harmful purposes.

This prohibition does not prevent users from voluntarily sharing their own information where they choose to do so.

However, users should carefully consider what information they disclose online.

 

15. Stalking and Unwanted Monitoring

You must not use NOVA to stalk, monitor or repeatedly track another person.

This includes:

  • Repeatedly contacting someone across different communities or accounts after they have asked you to stop;

  • Creating new accounts to continue contacting someone who has blocked you;

  • Monitoring someone's activity for the purpose of intimidation;

  • Attempting to discover or expose someone's private location;

  • Using information obtained through NOVA to facilitate stalking or harassment.

Blocking another user must be respected.

 

16. User-Generated Content

NOVA may allow users to create, upload, publish or share content, including:

  • Text;

  • Photographs;

  • Videos;

  • Audio;

  • Profile information;

  • Community posts;

  • Comments;

  • Messages;

  • Reviews;

  • Other forms of user-generated material.

You are responsible for the content you submit.

Content must not:

  • Violate this AUP;

  • Violate another person's rights;

  • Infringe intellectual property rights;

  • Contain unlawful material;

  • Mislead users;

  • Facilitate fraud or abuse;

  • Contain malicious software;

  • Expose another person's private information without permission.

You should only upload content that you have the right to use.

 

17. Intellectual Property

You must respect intellectual property rights.

You must not use NOVA to:

  • Upload copyrighted material without appropriate rights or permission;

  • Distribute pirated content;

  • Infringe trademarks;

  • Copy or reproduce another person's protected work unlawfully;

  • Misrepresent someone else's work as your own.

If you believe content on NOVA infringes your intellectual property rights, you may contact us using the contact details provided on our website.

 

18. Malicious or Technical Misuse

You must not attempt to interfere with the operation, security or integrity of NOVA.

This includes:

  • Attempting to gain unauthorised access to NOVA systems;

  • Accessing another user's account;

  • Circumventing authentication or security controls;

  • Introducing malware, viruses or malicious code;

  • Conducting denial-of-service attacks;

  • Attempting to disrupt NOVA's infrastructure;

  • Reverse engineering or exploiting vulnerabilities except where expressly permitted;

  • Scraping or systematically extracting data without authorisation;

  • Using automated tools to interact with NOVA without permission;

  • Circumventing technical restrictions.

You must not use NOVA to test, probe or attack our systems without our prior written authorisation.

 

19. Automated Tools and Artificial Intelligence

NOVA may use artificial intelligence and automated systems to provide features such as recommendations, matching, moderation, personalisation or assistance.

You must not use bots, scripts, automated systems or artificial intelligence tools to manipulate NOVA or deceive other users.

This includes using automation to:

  • Create large numbers of accounts;

  • Send mass messages;

  • Generate fake engagement;

  • Manipulate matches;

  • Scrape user information;

  • Circumvent moderation;

  • Impersonate people;

  • Conduct scams or fraudulent interactions.

You remain responsible for content and actions generated or assisted by tools you use.

 

20. Manipulation of Relationships and Matching

NOVA is designed to facilitate meaningful connections.

You must not deliberately manipulate another person's understanding of your identity, intentions or circumstances for the purpose of obtaining emotional, romantic, financial or other benefits.

This includes:

  • Pretending to seek a genuine relationship when your primary purpose is fraud;

  • Deliberately misleading people about your identity;

  • Using multiple identities to manipulate users;

  • Manipulating matching systems;

  • Using matches to target or harass particular users.

NOVA does not guarantee that a match, recommendation or connection will result in a relationship or that another user is compatible, genuine or trustworthy.

 

21. Community-Specific Rules

Individual NOVA communities may have additional rules appropriate to their purpose.

For example, a community focused on careers may restrict promotional content, while a cultural discussion community may have additional standards concerning respectful discussion.

Where a community has additional rules, you must comply with both:

  1. This AUP; and

  2. The applicable community rules.

Community-specific rules cannot permit conduct that is prohibited by this AUP.

 

22. External Links and Third-Party Services

Users may share links to external websites or services where permitted.

You must not use NOVA to distribute:

  • Phishing links;

  • Malware;

  • Fraudulent websites;

  • Deceptive offers;

  • Unlawful content;

  • Links designed to steal credentials or personal information.

NOVA is not responsible for the content, security or practices of third-party websites or services.

Users should exercise caution before following external links or providing information to third parties.

 

23. Reporting Concerns

If you encounter behaviour or content that you believe violates this AUP, you should report it to NOVA using the reporting tools available within the Services or through the contact details provided on our website.

Where available, reports may be made from:

  • User profiles;

  • Messages;

  • Community posts;

  • Other relevant content.

When reporting an issue, provide enough information for us to understand the concern.

Do not deliberately submit false or malicious reports against another user.

 

24. How NOVA Handles Reports

When we receive a report, we may review the relevant information and take action where appropriate.

Depending on the circumstances, we may:

  • Review the reported content;

  • Ask for additional information;

  • Remove or restrict content;

  • Restrict certain account functionality;

  • Issue a warning;

  • Temporarily suspend an account;

  • Permanently terminate an account;

  • Restrict access to particular communities;

  • Block communication between users;

  • Refer serious matters to appropriate authorities where legally required or appropriate.

We may use automated systems, human review, or a combination of both when assessing reports and enforcing our policies.

Not every report will result in enforcement action.

 

25. Enforcement

We may take action when we reasonably believe that a user has violated this AUP, our Terms of Service, applicable law, or poses a risk to the safety, security or integrity of NOVA or its users.

Enforcement may include:

Warning

We may issue a warning and ask the user to change their behaviour.

Content Removal

We may remove or restrict content that violates our policies.

Feature Restrictions

We may restrict access to particular features, communities, messaging functions or matching functionality.

Temporary Suspension

We may temporarily suspend an account while we investigate a violation or as an enforcement measure.

Permanent Termination

We may permanently terminate an account where we consider the violation sufficiently serious, repeated or otherwise incompatible with continued use of NOVA.

Immediate Action

For serious matters, including threats, exploitation, fraud, child-safety concerns, severe harassment, serious security threats or other significant risks, we may take action without first issuing a warning.

 

26. Circumventing Enforcement

If your account is restricted, suspended or terminated, you must not attempt to circumvent the restriction by:

  • Creating another account;

  • Using another person's account;

  • Using false identity information;

  • Using technical measures to bypass restrictions;

  • Asking another person to act on your behalf.

Attempting to circumvent enforcement may result in further restrictions.

 

27. Appeals

Where NOVA provides an appeal process for a moderation or enforcement decision, users may submit an appeal through the relevant mechanism.

An appeal should explain why you believe the decision was incorrect and provide any relevant information.

We will review appeals in accordance with our internal processes and applicable legal requirements.

Submitting an appeal does not automatically restore restricted content or account access.

 

28. Protecting Freedom of Expression

NOVA supports respectful discussion and recognises that people will disagree.

We do not intend to remove content simply because it is unpopular, controversial or different from our views.

However, expression may be restricted where it crosses into conduct prohibited by this AUP, including threats, harassment, targeted abuse, discrimination, fraud, exploitation, unlawful activity or serious safety risks.

Our objective is not to eliminate disagreement. It is to maintain an environment where people can participate without being subjected to abuse or exploitation.

 

29. No Guarantee of User Identity or Behaviour

NOVA may use verification, moderation, matching technology and other safety measures, but no online platform can guarantee that every person is who they claim to be or that every interaction will be safe.

You are responsible for exercising reasonable judgement when interacting with other users.

You should consider taking appropriate precautions when:

  • Sharing personal information;

  • Moving conversations to another platform;

  • Meeting someone offline;

  • Sending money;

  • Sharing intimate content;

  • Sharing sensitive information.

Never send money to someone solely because you have developed an online relationship with them.

 

30. Offline Meetings and Relationships

If you choose to meet another NOVA user offline, you do so at your own discretion and risk.

We recommend that users:

  • Meet initially in a public place;

  • Tell someone they trust where they are going;

  • Arrange their own transportation;

  • Avoid sharing unnecessary personal information;

  • Be cautious about financial requests;

  • Leave an interaction if they feel uncomfortable or unsafe.

NOVA is not responsible for the conduct of users outside the Services, except to the extent required by applicable law.

 

31. Legal Compliance

You must comply with all laws and regulations applicable to your use of NOVA.

You must not use NOVA to facilitate:

  • Fraud;

  • Money laundering;

  • Terrorist activity;

  • Human trafficking;

  • Child exploitation;

  • Serious criminal activity;

  • Intellectual property infringement;

  • Unlawful discrimination;

  • Unauthorised access to computer systems;

  • Other unlawful activity.

We may cooperate with law enforcement, regulators or other competent authorities where required by law or where legally permitted and appropriate.

 

32. Data Protection and Privacy

NOVA processes personal information in accordance with its Privacy Policy.

Our handling of personal data is governed separately by our Privacy Policy and applicable data protection laws.

Nothing in this AUP is intended to replace or limit rights that users have under applicable data protection legislation.

33. Changes to This Policy

We may update this AUP from time to time to reflect:

  • Changes to NOVA;

  • New features;

  • Changes in law;

  • Changes in regulatory requirements;

  • New safety risks;

  • Changes in community standards.

When we make material changes, we will take reasonable steps to notify users where required.

The "Last Updated" date at the top of this policy indicates when it was most recently revised.

35. Acceptance

By creating an account or using NOVA, you acknowledge that you have had an opportunity to review this Acceptable Use Policy and agree to comply with it.

If you do not agree to comply with this AUP, you must stop using NOVA.
